Terms of service

This is a draft. It describes how we work today and will be reviewed by a lawyer before it becomes final.

Who we are

ToBrand is a web design, development, branding and SEO agency based in Pune, Maharashtra, India, and part of the pikk.company family. "We" means ToBrand; "you" means the business or person hiring us.

Quotes

Every project starts with a written, itemised quote that sets out the scope, the stages, the timeline and the price. Prices on this website are starting prices and exclude GST unless stated. Work outside the agreed scope is quoted separately before we start it.

Payments

We ask for an advance to begin. After that, each stage is invoiced when you approve it. Invoices are payable within the time shown on them. If a payment is late, we may pause work until it is cleared.

Your responsibilities

• Share content, logins and feedback on time, so the timeline can hold.
• Make sure you have the right to use the text, photos and logos you give us.
• Review each stage and either approve it or tell us what to change.

Timelines

The timeline in your quote assumes feedback within a few working days at each stage. Delays in content or feedback move the dates by the same amount.

Changes and revisions

Each stage includes the rounds of changes listed in your quote. Larger changes, or changes after a stage is approved, are quoted before we do them.

Ownership

When the project is paid in full, you own the final website, design files and content we created for you. Third-party items, such as fonts, plugins, themes, stock photos and platform subscriptions, stay under their own licences, which we will tell you about. We may show the finished work in our portfolio unless you ask us not to.

Hosting, domains and third parties

Domains, hosting and platforms such as Shopify, Wix or Webflow are billed by those providers, or passed on at cost. We are not responsible for their outages or price changes, but we will help you deal with them.

Support after launch

Every website includes 30 days of free fixes after launch for anything that does not work as agreed. Ongoing updates, SEO and maintenance are available as separate plans.

Liability

We take care to deliver work that works as agreed. To the extent the law allows, our total liability for any claim is limited to the amount you paid us for the project concerned, and we are not liable for indirect losses such as lost profits.

Ending a project

Either side may end a project in writing. You pay for the stages completed and approved up to that point, and for work in progress as set out in the refund policy. We hand over everything you have paid for.

Governing law

These terms are governed by the laws of India, and the courts of Pune, Maharashtra, have jurisdiction.
